The ACLU of Maine has filed a lawsuit against a Portland Police officer on behalf of a Bar Harbor couple who were arrested for videotaping police officers on a public street. In the compliant against Portland police Sgt. Benjamin Noyes Jr., the ACLU, claim that the arrest of the couple was 'illegal and unconstitutional' and that the officer violated their First Amendment and Fourth Amendment rights.

The Bar Harbor couple were arrested this past May for using their smartphone to visually record Portland police officers who were questioning a woman on the sidewalk of Spring Street in Portland. The couple decided to record this out 'of concern for the woman and out of concern for police abuse of power.'
