Maine Man Charged After He Allegedly Threw “Bodily Fluids” On a Woman

According to an article on the WGME website, a Falmouth man has been charged with assault after Portland police say he allegedly threw a bodily fluid at a woman walking along Forest Avenue.

According to the Portland Police Department, officers responded to the area of 417 Forest Ave. around 6:15 on Wednesday evening after a 33-year-old woman reported that a man got out of a truck, followed her and threw a substance from a small container onto her.

Police said a witness reported seeing the man following the woman and believed they saw him throw something at her.

The woman said she first became alarmed when she noticed someone walking closely behind her.

She said she was unable to immediately cross the street because of traffic, but felt increasingly uneasy as the man continued to approach.  Moments later, she said she saw him make a throwing motion and felt something wet hit her leg and lower body.

The victim of the alleged assault said she believed the substance was semen.

She said she confronted the man before calling police, adding that several witnesses observed what happened. The article explains that the victim said she does not know the suspect and believes the encounter was random.  She also said she is unsure whether the bodily fluid was thrown directly or had been collected in a container beforehand.

Police later identified the suspect as 22-year-old Theo Orestis of Falmouth.  He was issued a summons charging him with misdemeanor assault but was not taken into custody.

Julie said investigators returned to the scene the following day to gather additional evidence and review surveillance video from nearby businesses.

She also said officers did not immediately collect the bodily fluid from the scene, so, because she is a nurse and had gloves available, she gathered the evidence herself.

Portland police said the circumstances of the incident meet the legal definition of assault under Maine law.  Investigators noted that while the alleged substance involved is unusual, it does not change the classification of the offense, which remains a misdemeanor.
